Whitefastmovers.org's use of Others' Footage Showing White Fast Movers Falls Under Fair Use in the U.S. and Related Rules in the E.U. and U.K.
We clarify the application of the fair use doctrine (17 U.S.C. § 107) with reference to the four factors for fair use in the following.
1 Purpose and character of the use: Whitefastmovers.org is a private research project. Its primary goal is non-commercial. Our use of others' material is limited to the transformative goal of scientifically presenting and discussing the phenomenon of white fast movers.
2 Nature of the copyrighted work: all work we cite is published on YouTube, other website or academic journals. All work we cite is non-fictual with the intention of documentation or scientific discovery. All work we cite is crucially important to the scientific goals of whitefastmovers.org.
3 Amount and substantiality of what has been taken from the copyrighted work: we only cite the smallest possible video sequence, screen shot or photograph necessary to achieve the scientific goal of whitfastmovers.org. In instances of other users' videos, the relevant video sequences are only a few seconds of a longer video. In cases of videos with commercial intent rather than highlighting the occurrence of the white fast movers phenomenon, we only take small portions of the video that are not central or significant to the entire work.
4 Effect of the use upon the potential market for the copyrighted work: None of our uses of others' material has a negative effect on the original's potential market value. Quite contrary, our mentioning of the sources brings extra attention to the material and their publishers.
Note that the comments to factors 1 and 4 translate to copyright exceptions under U.K.'s fair dealing concept. in relation to the German Zitatrecht (§ 51 S. 2 Nr. 1 UrhG) and in accordancce with comments to factor 1, whitfastmovers.org is to be classified as selbständiges wissenschaftliches Werk that can legally cite the material it aims to investigate scientifically.
